Publication 590-A discusses contributions to individual retirement arrangements (IRAs). An IRA is a personal savings plan that gives you tax advantages for setting aside money for retirement.
What can the IRS do to an IRA account holder if it determines that the person put in more than the maximum contribution limit permitted by law?
If you contribute more than the traditional IRA or Roth IRA contribution limit, the tax laws impose a 6% excise tax per year on the excess amount for each year it remains in the IRA.
Can you contribute to a Roth IRA in PUB 590 A?
No. You can be any age. See Can You Contribute to a Roth IRA? in chapter 2. You may be able to deduct your contributions to a traditional IRA depending on your income, filing status, whether you are covered by a retirement plan at work, and whether you receive social security benefits.
How do I report excess withdrawal contributions?
You will need to include Form 5329 with your filing to reflect that the withdrawn contributions are no longer treated as having been contributed. If the excess generated any earnings, you’ll need to remove them and include them in your gross income.
Can I reverse an IRA contribution?
IRA contributions have to be reversed within the same tax year. Get your IRA ending balance of the month just before the contribution you want to reverse. You can find this information in your account statements, in print or online. We’ll call this figure the starting balance.
Are earnings on excess contributions subject to 10 penalty?
If you remove your excess contribution plus earnings before either the April 15 or October 15 deadline, the earnings are taxed as ordinary income. And if you’re under 59½, you’ll be subject to a 10% early withdrawal penalty.
How do I fix over contributed to my 401k?
Get a new W-2 and pay taxes. The returned excess contribution will be added to your total taxable wages for the previous year, so an amended W-2 will be issued. Your tax bill will rise (or your refund will shrink) relative to the amount of the excess 401(k) contribution.
